Terms & Conditions

Studio Orange provides its services under the following Terms and Conditions. By accepting a quote issued by us, you agree to these Terms and Conditions.

Proposal & Quote Acceptance

Our proposals and quotes are valid for 10 working days. When a proposal is not accepted within 10 working days Studio Orange is unable to guarantee the availability of its teams and pricing.

Pre-paid quotes and proposols need to kick off within 6 months of payment, they can be subject to a price increase if not started within 6 months.

Production Process
Production will start upon acceptance of a quote. Our client has to sign the proposal document to accept the proposal.

Ownership of Recorded Material
The recorded Raw Footage, Video Files, Audio Files and Edited Video Files, including all copyright will remain the property of Studio Orange, unless a different agreement has been made. The Client owns the edited product of the video, not the raw footage. The copyright for all and any music and lyrics or musical composition included or recorded in the edited video or recorded by equipment used by Studio Orange will remain the property of the author or legal entity owning the copyright.

Promotional purpose of footage
Studio Orange reserves the right to use edited or unedited video from all productions or commissioned works for promotional or commercial purposes. The copyright for the segments will belong to Studio Orange exclusively. The segments may be used on their website or may be sent to clients as a sample.

Disposal of Recorded Materials
Raw Footage, Video Files & Audio Files will be retained for up to six (6) months only and will then be disposed of, deleted or erased, unless a different agreement is made. It is the client’s responsibility to make sure they have backups of their videos. Studio Orange can store clients’ footage and project files on our backup storage after the first 6 months have passed for $100 (ex.gst) per year.

Illness or Failure of Equipment
Whilst all reasonable care and preparation is taken for videography and editing, Studio Orange shall not be liable for any compensation, should a failure occur for all or any of the electronic equipment used or due to illness of the operator or person(s) employed by Studio Orange or because of an unforeseen event, like failure of equipment or by any dispute regarding the ownership of recorded materials.

Venue Location Fees & Permissions
It is the responsibility of the client to meet any fees or to ensure that permission is sought and obtained at all venues and locations for the videography of events or commissioned works

Artistic License
The client acknowledges and accepts that editing an event and the production of finished materials may include elements of artistic expression and interpretation. Studio Orange reserves the right to use ‘Artistic License’ in any commissioned works that require editing or the production of finished materials. The client has two (2) rounds of revisions to make to the ‘first edit’ and in order to maintain strict deadlines the client is required to provide all proposed changes to the ‘first edit’ within seven (7) days of receiving the ‘draft copy’. Once the changes are made the client will receive a ‘final draft copy’ for which they get one more round of adjustments and after these are made the client received the ‘final edit’.
If more changes are needed after the ‘final edit’ the client will be charged an hourly rate for the additional changes the Studio Orange team has to make.

All revisions and requests for changes need to be provided to Studio Orange within 2 months of delivery of draft 1. Any revision requests after this time can incur additional costs.

Payment for Goods and Services
Studio Orange will issue a 50% deposit invoice on projects of value of $4000 (ex.gst) or higher. The deposit invoice will be issued on acceptance on the quote. For projects under $4000 (ex.gst) we will invoice on delivery of the first video draft.

  • Studio Orange will include a number of hours of shooting in a proposal. If this number is exceeded and more time is spent for the video shoot, the team will log their hours and the invoice will list an additional hourly rate.
  • Studio Orange charges a fee for the handover of project files
  • Studio Orange charges extra costs if a voice over has to be re-recorded
  • Studio Orange charges our hourly rate for revisions to video drafts that were outside of the scope of the approved storyboard
  • Studio Orange charges our hourly rate if the video needs to be exported and adjusted to suit an alternative aspect ratio

Content Disclosure
Clients understand that the content, the views and the opinions expressed in the video material produced for the client (YOU), by Studio Orange, are those solely of the client (YOU). The material is intended to represent the opinion of the client (YOU), and in no way reflects the views and opinions of Studio Orange and its staff.

Privacy
All information received from customers, written or otherwise will be kept confidential. Any private information provided will not be divulged or distributed to any third party.
